Terms of Service

These terms are the agreement between you and NAP (Neuro Athletic Performance) about how you use the app. Most of the athletes who use NAP are under 18, so this is written to be read by an athlete and by a parent. Using the app means you agree to what's below.

1. What NAP is

NAP is a mental performance coaching app for athletes. It uses an AI coach to help you train focus, confidence, pressure handling, and recovery — the mental side of your game — through a curriculum, your pre-ice and post-ice routines, and a record of what you've done.

NAP is not therapy, diagnosis, or medical treatment, and the AI coach is not a licensed mental health professional. NAP does not diagnose, treat, cure, or prevent any medical or mental health condition, and it is not an emergency or crisis service. The full wording is on our Disclaimer page — the same copy you agree to inside the app, which nothing in these terms changes.

2. Who can use NAP, and parents

NAP is built for youth athletes, and most of the people using it are minors.

Status: TBD, and it is the same open decision flagged in the Privacy Policy — the two documents have to be answered together. NAP records a single under 18 bracket, does not ask for a date of birth, and does not yet collect a parent's email or run a verifiable parental consent flow. Counsel to decide, before launch:

4. The coach is an AI

The coach's replies are generated by an AI model. No person writes or reviews them before you see them, and they can be wrong, incomplete, or off-base. Treat them as coaching to think about, not as instructions to follow without judgment.

Do not rely on the coach for anything medical, psychological, or urgent. The coach is not a doctor, therapist, or emergency service, and it cannot get help to you. NAP and its team are not responsible for your personal mental health. If you're struggling with anxiety, depression, trauma, or anything else — or need support beyond performance coaching — it's on you to do your own due diligence and reach out to a qualified therapist, healthcare provider, or other professional support.

5. How you may use NAP

Use NAP for your own athletic development. That's what it's for. While you're using it, don't:

What you type stays yours. Your messages to the coach, your goals, your journal entries, your routines, and your reflections belong to you. We don't claim ownership of them.

You give us permission to use them to run the app — to store them, send them to the service providers listed in our Privacy Policy so the coach can reply, personalize your curriculum and routines, and show you your record. That permission exists so the service can work, and it ends when you delete your account.

The app itself is ours. The curriculum and lessons, the session and exercise scripts, the guided audio, the characters, the artwork and gear designs, the NAP name and logo, and the software are owned by us or our licensors, and are protected by copyright and other laws. You get a personal, limited, non-transferable licence to use them inside the app while your account is open. You may not copy, redistribute, publish, sell, or share that content outside the app — including the curriculum, the scripts, and the audio.

7. XP, gems, levels, and gear

Nothing you unlock in NAP has real-world value. XP, levels, gems, streaks, chests, and the gear your character wears are features of the app — not property, not currency.

8. Payments

There are no purchases in NAP at launch. There are no subscriptions, no in-app purchases, and no paid tiers, and we do not collect payment card information.

For legal review — what changes if a paid tier ships

Nothing paid exists today, and per our product rules no real-money mechanic ships without legal sign-off, because the users are minors. Before any paid feature launches, counsel to supply: subscription and auto-renewal terms with the disclosures Apple and consumer protection law require, the fact that billing runs through the App Store and refunds are handled by Apple, free-trial and cancellation language, price-change notice, and whatever additional consent a minor's purchase needs from a parent or guardian. A paid tier would also change section 7 — counsel to confirm that virtual items bought with real money can still be described as having no cash value.

9. Ending your account

You can stop using NAP whenever you want, and you can delete your account from inside the app: Profile → Delete account. If you're locked out and can't reach that screen, email support@neuroathleticperformance.com from the address on the account. A parent or guardian can make the same request on behalf of their athlete.

Deleting removes your data — your profile, your coach conversations, your routines and schedule, your journal entries, and your progress — and it is not reversible. Exactly what is removed, and how long backups take to catch up, is in our Privacy Policy.

We can end your access too if you break these terms or use the app in a way that harms other people or the service, and we may change or discontinue features as the product develops.

10. Disclaimers and limits on our responsibility

NAP is provided as it is. We work hard to make it good, but we don't promise it will be uninterrupted, error-free, or right for every person, and we don't promise any particular result — in your sport or anywhere else. Performance coaching is not a guarantee of performance.

You are responsible for what you do with it. Decisions about your health, your training, your injuries, and your mental health belong to you and the qualified professionals you work with — not to an app.

For legal review — warranty disclaimer and limitation of liability

The plain-English paragraphs above are the product's honest position, not an enforceable clause. Counsel to supply the operative warranty disclaimer, liability cap, and exclusions — and to check what Canadian consumer protection law (BC, and Quebec's stricter rules) and US state law permit to be disclaimed against a minor and their parent, where a free app with no fees complicates any cap tied to amounts paid. Also needed: whether indemnification by a parent or guardian belongs here, how any of this interacts with the mental-health context without weakening the in-app disclaimer, and whether Apple's required end-user licence minimum terms (Apple as third-party beneficiary included) must be incorporated.

11. Which law applies

For legal review — governing law and disputes (open decision)

Status: TBD. The company is Canadian (British Columbia); users will be in Canada and the United States, and they are minors. Counsel to choose the governing law and forum, and to decide whether an arbitration clause or class-action waiver is appropriate or enforceable given a minor user base — and whether a separate consumer-dispute path is required for Quebec or for any US state.

12. Changes to these terms

If we change these terms, we will update the effective date at the top of this page and, for material changes, notify you in the app. If you keep using NAP after a change takes effect, that's your agreement to the new version. If you don't agree, delete your account.
